PCP Possession in New York: Penalties

Under New York law, PCP (phencyclidine) is classified as a Schedule I substance. As such, the penalties that may be imposed are among the harshest for any type of controlled substance. Following are the penalties that may be enforced for PCP possession, the least serious of all drug crimes involving this substance. Increased penalties will apply in cases involving possession with intent to distribute, PCP trafficking, manufacturing or sale.

Possession of 50 milligrams of PCP is a fifth degree drug possession offense, categorized as a class D felony and punishable by up to 7 years in state prison.

Possession of 250 milligrams of PCP is a class C felony, punishable by up to 15 years in state prison and a fine of up to $15,000. The same penalties apply for an offense involving 50 milligrams or more, if the offender had the intent to sell it and was previously convicted for an offense of this kind.

Possession of 1.25 grams of PCP is a class B felony, punishable by up to 25 years in state prison and a fine of up to $30,000.
